MDG Achievers Terms and Conditions.

The following Terms and Conditions apply to use of all The People’s Foundation free and charged for services in the MDG Achievers services solution.

1 - Community Membership Terms and Conditions.

a) These Community Membership Terms and Conditions constitute the terms and conditions for your Community Services Membership with The People’s Foundation MDG Achievers service and other Community services offered by The People’s Foundation Limited and your use of this community campaign and collaboration website. By registering on this website and accepting The People’s Foundation MDG Achievers Membership Terms and Conditions, you agree to accept and abide by the terms and conditions stated in these MDG Achievers Membership Terms and Conditions. Any infringement of these MDG Achievers Membership Terms and Conditions may result in loss of all or some community, campaign and collaboration services access and specific text, voice or video services access as well as your Membership being cancelled and you being barred from one or more of our websites. If you do not agree to these MDG Achievers Membership Terms and Conditions do not use this website, subscribe to The People’s Foundation MDG Achievers membership, subscribe to any of The People’s Foundation Services, purchase any of The People’s Foundation products or subscribe to or purchase any service or products offered by merchants participating in The People’s Foundation portfolio of services.

 

2 - Age Restriction

a) You MUST be over 18 years old to be a member of The People’s Foundation, use any of our free services or subscribe to any of our charged for subscription services.  If you are under 18 years old you are not allowed to register with the MDG Achievers service on this website or use any part of it. We accept no liability for the actions of persons under 18 who use this website.

 

3 - Membership

a) Your Membership is for your Personal, Company or Organisational use only, as the case may be. You may not authorise other people outside of your Personal, Company or Organisational authority to use the site under your Membership or give your Username and Password details to other people. You are solely responsible for the confidentiality of your Personal, Company or Organisational Username and Password and any actions performed through your Personal, Company or Organisational account under your Username and Password. If your password has been disclosed to someone else you must change it immediately and inform us at admin@mdgachievers.com. You undertake as a Personal, Company or Organisational Member to maintain a full, up-to-date and accurate Registration Profile, based on your Personal, Company or Organisational Registration.

 

b) The People’s Foundation reserves the right to take the following actions regarding your membership with immediate effect at any time: change or delete any content on this site, including usernames, messages, and personal profile information, on the grounds of infringement of the rules, refuse membership, terminate membership or accounts, refuse access to or limit your use of parts of the site, amend the rules, change the membership fees, email you with periodic bulletins, updates or other information, and monitor your communications with other MDG Achievers members.

 

4 - Use of the Site

a) You are solely responsible for your interactions with other MDG Achievers members. We reserve the right, but have no obligation, to monitor disputes between you and other members. You acknowledge that other users will be able to view your profile, see your website, your campaigns and your projects, find you through our member search facilities and make contact with you. You are solely responsible for any content you submit to your profile on the site, in your campaigns, your projects and any actions performed through your account.

 

b) You will not submit material to the site that is inflammatory, obscene, racist, abusive, libellous, threatening, harassing or illegal, or that infringes any third party's privacy, copyright or intellectual property rights. You will not forge or fake emails, letters or any other communications from other Members, or from MDG Achievers or from The People’s Foundation.

 

c) You are free to post your personal, company or organisational details such as your telephone number, address and/or e-mail address or your website URL in your profile or member directory or any other information which would allow other members and/or users to contact you directly so long as you agree that you are fully and totally responsible for any and all communications that may arise as a result of these information postings and for any further interaction between you and other members, companies and organisation that may arise from these communications.

 

d) You warrant and represent to us that all information posted by you, your company or organisation is accurate, true, complete and is not misleading.

 

e) You are free to solicit business and advertise products or services on this site and through your MDG Achievers campaign media so long as you state clearly that you are doing so in support of the Millennium Development Goals.

 

f) You will not under any circumstances send spam, junk mail or chain letters to other MDG Achievers Members.

 

g) You will not use the MDG Achievers service to promote another site, service and/or business that is not your own in any way, including but not limited to posting any personal e-mail addresses, URL's and/or other third party Personal, Company or Organisational telephone numbers in your profile.  You may however promote an Email, website or SMS message of yours built with the MDG Achievers Unified Community Campaign service so long as you clearly state that you, your Company or Organisation are fully responsible for all content on your campaign Email, SMS and or Website.

 

h) You may not use any of The People’s Foundation or MDG Achievers software solutions to create emails, sms’s, webpages, blogs or website profile within The People’s Foundation MDG Achievers service that contains inflammatory, obscene, racist, abusive, libellous, threatening, harassing or illegal content, or that infringes any third party's privacy, copyright or intellectual property rights. You will not use your Email, SMS, Webpage, blog or website profile built with The People’s Foundation MDG Achievers software to forge or fake emails, letters or any other communications from other Members, or from The People’s Foundation or MDG Achievers.

 

i) You will not impersonate another Member of MDG Achievers or The People’s Foundation, or any other third party associated with The People’s Foundation MDG Achievers service.

 

j) You will not attempt to access pages of any of The People’s Foundation or MDG Achievers websites except through our specific and particular website navigation system. You will not hack into any of the sites, or retrieve information using a computer program.

 

k) You will not transmit viruses, computer code, files or any program that may in any way be harmful on any of The People’s Foundation or MDG Achievers websites, to any of The People’s Foundation or MDG Achievers websites or to other members in the MDG Achievers community or to any of The People’s Foundation’s websites or to any MDG Achievers member’s website or websites.

 

l) If you arrange any meetings with any Person, Company or Organisation through your use of any of MDG Achievers services then you do so at your own risk. You should take any and all precautions you think necessary to ensure your own safety.

 

m) We are not liable for actions of, or content provided by, any Member of the MDG Achievers community which violate the Terms and Conditions.

 

n) We do not have the capacity to check that the profiles of MDG Achievers members are correct and not misleading. We do not make any representation or warranty that the information contained in any Personal, Company or Organisational profile is accurate and we are not under any obligation to verify any information contained in any profile in any Personal, Company or Organisational member of MDG Achievers.

 

o) Before acting on any information contained in any Member profile or on any information received by you through your use of any of MDG Achievers’ services, you should in your own time and at your own cost and expense, carry out such thorough and comprehensive investigation as you think necessary to satisfy yourself of the truth and accuracy of all such information.

 

5 - Guarantee

a) MDG Achievers services are provided in their current form and The People’s Foundation Limited does not guarantee that MDG Achievers services, or any element of any of the services will meet your requirements, purpose and/or expectations.

 

b) We do not warrant that all of the information and/or material provided in the MDG Achievers services are accurate.

 

c) We do not provide any warranty in respect of MDG chievers services, results, availability, consistency and/or uninterrupted use of the service.

 

d) We will operate the main MDG Achievers web site with the reasonable professionalism, commitment, and care of an Internet service provider.

 

e) We will do our best to maintain the operation of MDG Achievers website services, but advise that we may need from time to time to temporarily suspend any of the services for operational reasons such as maintenance, upgrades, server re-locating etc. We confirm our intention to on all occasions restore MDG Achievers services as soon as possible after any suspension.

 

f) We reserve the right to changes on any aspect of MDG Achievers and any related service from time to time provided that they do not have a material adverse effect on the quality of the overall service.

 

g) We will not be liable for any inability on our part to carry out what we have promised to in this agreement resulting from something beyond our reasonable control - including, without limitation, disputes involving our employees, consultants or MDG Achievers community members.

 

6 - Material Ownership

a) All content in and of the MDG Achievers services website and The People’s Foundation  websites, including website design, images, video, text, structure, pages, their selection, composition and arrangement, general content, Members' personal profiles information, all software compilations, meta tags, underlying source code, and all other material, constitutes The People’s Foundation Limited and MDG Achievers copyright. All rights reserved. You will not in any way copy, reproduce, or modify any part of the website without written permission of The People’s Foundation Limited. Neither will you sell or translate any of the content in the MDG Achievers service website or any other Community service website of The People’s Foundation.

 

b) We may at any time monitor and or keep records on any aspect of your activity on and use of the MDG Achievers website or campaign websites, including information about logs of your use of these websites and of your browser, any information or content you submit to these websites, the Personal, Company or Organisational profile details you submit to the services, images, pictures, public and private messages, and voice, text or video communications. In doing this we may place cookie files on your browser and receive information from them.

 

c) We reserve the right to copy, reproduce, alter or delete any content you submit to the MDG Achievers website including your profile, events, campaign and projects details, pictures, and public and private messages.

 

d) We will not sell or rent out your Personal, Company or Organisational information or disclose your email address or other contact information to any third party without your permission. We will use industry standard security measures to protect your information, and we undertake to comply with all obligatory privacy and data protection laws regarding your Personal, Company or Organisational information.

 

7 - Termination of Membership

a) You or The People’s Foundation Limited may terminate your MDG Achievers Membership or any of your use or subscriptions to any MDG Achievers services at any time by written notification including via email communication.

 

b) Your first month’s subscription fees of the MDG Achievers service after your first months’ free trial is refundable. Thereafter, all subscription fees of the MDG Achievers service and other The People’s Foundation subscription services are not refundable.  During the free trial you will have had the time to evaluate and or test the MDG Achievers services in question and therefore it is expected that should you proceed to subscribe and pay for the MDG Achievers service in question it is because the free trial has provided you with the level of satisfaction, confidence or security to proceed with the subscription payment for the relevant MDG Achievers service.

 

c) In exceptional circumstances at the sole discretion of The People’s Foundation, The People’s Foundation will refund a service fee beyond the first subscription month to a member on the sole condition that the member subscriber has requested refund directly from The People’s Foundation Limited, has provided all necessary evidence to support their request and has not initiated any charge back requests to credit card companies such as Mastercard or Visa.

 

d) If you breach the Membership Terms and Conditions, we may terminate your Membership of the MDG Achievers service immediately and without notice. We do not offer refunds for memberships terminated due to infringement of the Membership Terms and Conditions. The People’s Foundation may provide refunds on MDG Achievers subscription service in exceptional circumstances and such provisions will be at the sole discretion of The People’s Foundation Limited.

 

e) If you have been banned or deleted from MDG Achievers on the basis of an infringement of the MDG Achievers membership Terms and Conditions and/or The People’s Foundation services Terms and Conditions and then rejoin the website, The People’s Foundation Limited reserve the right to immediately delete you again without notice, and without refunding any fees paid.

 

8 - Disclaimer

a) The People’s Foundation Limited and MDG Achievers and all The People’s Foundation services hold no liability for users of the webpages, blogs or websites or of any of our services, who break any of our Terms and Conditions as stipulated here or on the services websites or on any part of the MDG Achievers general website or MDG Achievers’ profile, campaign or project websites.

 

b) You agree not to hold us liable for losses, breach of copyright, defamation, liabilities, damages, and expenses arising from your or other members' use of The People’s Foundation or MDG Achievers websites, infringement of the rules, or from any allegation of breach of copyright or other violation of intellectual property.

 

c) All opinions, advice, offers and information given on the MDG Achievers website by any Personal, Company or Organisational members of the MDG Achievers services are those of the respective writer Member and are not necessarily those of MDG Achievers or of The People’s Foundation Limited.

 

d) Members are solely responsible for the content provided under their account and for protection of their account with their username and password for MDG Achievers services.

 

e) We are not liable for the acts or omissions of other Members or users of the MDG Achievers services, emails, webpages, media, campaigns, projects, events, blogs or websites, whether authorised or unauthorised.

 

f) For the avoidance of doubt, any contract between you and The People’s Foundation Limited regarding any of The People’s Foundation services and MDG Achievers services or any other service will be deemed to have been concluded in the Isle Of Man, and will be interpreted,  construed and enforced in all respects in accordance with the laws of the Isle of Man and you submit to the non-exclusive jurisdiction of the Isle of Man Courts.

 

g) To the fullest extent permitted at law, The People’s Foundation Limited provides the MDG Achievers service and other services and their contents on an "as is" basis, making no (and expressly disclaiming all) representations or warranties of any kind with respect to the website supporting these services or any and all information, content, materials or products included in the websites.

 

h) Except as specifically stated on these websites, to the fullest extent permitted at law, The People’s Foundation Limited and its directors, affiliates, employees and other representatives will not be held liable for damages arising out of or in connection with the use of this site or the information, content, materials or products included on it. This is a comprehensive limitation of liability that applies to all damages, loss of data, income or profit, loss of or damage to property and claims of third parties. The People’s Foundation Limited, through the MDG Achievers service and other services, does not limit its liability for death or personal injury arising from negligence.

 

9 - Limitations of Liability

a) We shall have no liability for any defect or error in the MDG Achievers service and other Community services caused or contributed to by you and/or any other  Personal, Company or Organisational Members of any of our services.

 

b) We shall have no liability to any member if any monies owed by said member to us have not been paid in full by the due date for payment via our subscription service.

 

c) In the event of any claims being made by Members to The People’s Foundation Limited as a result of the MDG Achievers service and other services, Members shall produce written evidence of any claims to The People’s Foundation Limited for which it is alleged The People’s Foundation Limited or MDG Achievers is liable together with written details of how any loss was caused by The People’s Foundation Limited and/or MDG Achievers and the steps the Member in question has taken to mitigate the loss before The People’s Foundation or MDG Achievers shall have any liability for any claim by a Member of MDG Achievers service and other services

 

d) All Personal, Company or Organisational Members shall give MDG Achievers and The People’s Foundation Limited reasonable opportunity to remedy any matter for which we are liable before said Member incurs any costs and/or expenses in remedying the matter. If said Member does not do so The People’s Foundation Limited shall have no liability to said Member.

 

e) It is possible for Personal, Company or Organisational Members and/or unauthorised user's of the MDG Achievers service and other The People’s Foundation services to obtain and misuse information about other Members of the MDG Achievers service and other services as a result of the general usability of the MDG Achievers service and other services.  We shall have no liability to you arising out of any Personal, Company or Organisational Members and/or unauthorised user's misuse of information and/or other material posted by any Member on the service and/or to other Members.

 

f) Our total Liability to any member under and/or arising in relation to any agreement shall not exceed 5 times the amount paid by you for the service (if any) under that agreement or the sum of £250, whichever is the higher.

 

10 - Indemnity

a) All Personal, Company or Organisational Members agree to indemnify and keep indemnified The People’s Foundation Limited and MDG Achievers and all members of our staff against any and all losses, proceedings, lost profits, damages, expenses, costs, awards, (including increased administration costs and legal costs on a full indemnity basis), actions, claims, and any other losses and/or liabilities suffered by The People’s Foundation Limited and or MDG Achievers and arising from and/or relating to your use of the MDG Achievers service and other services, information and/or other material posted on the MDG Achievers service and other services websites by you and/or arising from or due to any breach of contract, any act and/or omission and/or any breach of statutory duty by you.
